Welcome to LushAIChat, a mobile application provided by Lushai Technologies & Consulting Pvt. Ltd. ("LushaiTech," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the LushAIChat mobile application and related services (collectively, the "Service"), which is an AI-powered chat application.

5. User Content and Conduct

You retain ownership of any content you submit, post, or display on or through the Service ("User Content"), including your chat prompts and any data generated by the AI in response. By submitting User Content, you grant LushaiTech a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Service, including for the purpose of improving our AI models as further described in our Privacy Policy.
5.2. Prohibited Conduct
You agree not to use the Service to:
- Post, upload, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Interfere with or disrupt the Service or servers or networks connected to the Service.
- Attempt to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks connected to the Service, through hacking, password mining, or any other means.
- Violate any applicable local, state, national, or international law.
6. Account Deletion

You may request to delete your LushAIChat account at any time through the settings within the mobile application or by contacting our support team at INFO@LUSHAITECH.COM.
6.2. Deletion Process
Upon receiving your deletion request, we will initiate the process of deleting your account and associated personal data in accordance with our Privacy Policy and applicable data protection laws, including Google Play Store and Apple App Store policies. This process may take a reasonable period to complete.
6.3. Data Retention
Please note that even after account deletion, some data may be retained for a limited period as required by law, for legitimate business purposes, or as outlined in our Privacy Policy.
7. Intellectual Property Rights
All rights, title, and interest in and to the Service (excluding User Content) are and will remain the exclusive property of Lushai Technologies & Consulting Pvt. Ltd. and its licensors. The Service is protected by copyright, trademark, and other laws of both India and foreign countries. Nothing in the Terms gives you a right to use the LushAIChat name or any of the LushaiTech trademarks, logos, domain names, and other distinctive brand features.

The Service is provided "as is," without warranty of any kind, either express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. LushaiTech does not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.
9. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall LushaiTech, its affiliates, directors, employees, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use, or alteration of your transmissions or content.

You agree to defend, indemnify, and hold harmless LushaiTech, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.
11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in India.
